TJV ATV Affiliate Program – Terms & Conditions

These Terms & Conditions (“Terms”) govern your participation in the TJV ATV Affiliate Program (“Program”). By applying for and participating in this Program, you agree to comply with these Terms. If you do not agree, you may not participate.

1. Eligibility

  • You must be at least 18 years old and legally capable of entering into contracts in your jurisdiction.

  • You must provide accurate and complete registration information.

  • TJV ATV reserves the right to approve or reject any application at its sole discretion.

2. Affiliate Responsibilities

As a TJV ATV Affiliate, you agree to:

  • Promote TJV ATV tours and services in a truthful and ethical manner.

  • Only use marketing materials approved or provided by TJV ATV.

  • Comply with all applicable laws, including advertising, consumer protection, and data privacy laws.

  • Avoid spam, misleading advertising, or any form of dishonest marketing.

  • Not make any false claims about TJV ATV services, pricing, or policies.

3. Prohibited Activities

Affiliates must not:

  • Use TJV ATV’s trademarks, branding, or content without permission, except as provided in the Program materials.

  • Engage in fraudulent activity to generate sales or commissions.

  • Bid on TJV ATV’s brand name or trademarks in search engine advertising.

  • Promote TJV ATV on websites or platforms containing adult, violent, or illegal content.

  • Misrepresent themselves as employees or official representatives of TJV ATV.

4. Commissions & Payments

  • Commission rates will be specified in your affiliate account or agreement.

  • Commissions are earned only on completed bookings made through your unique affiliate tracking link.

  • No commission is paid for cancelled, refunded, or fraudulent bookings.

  • Payments are made [monthly/quarterly] via [bank transfer/e-wallet] once your commission balance reaches [minimum payout threshold, e.g., RM100].

  • You are responsible for any taxes due in your jurisdiction.

5. Tracking & Attribution

  • Bookings must be made through your unique affiliate link to be eligible for commission.

  • TJV ATV uses a [cookie-based/tracking code] system to attribute sales to affiliates.

  • Tracking accuracy depends on the user’s browser settings and behavior; TJV ATV is not liable for lost commissions due to tracking failures.

6. Intellectual Property

  • All TJV ATV logos, images, videos, and promotional materials remain the exclusive property of TJV ATV.

  • Affiliates are granted a limited, non-exclusive, revocable license to use provided marketing materials solely for Program purposes.

7. Termination

  • Either party may terminate participation in the Program at any time by giving written notice.

  • TJV ATV may terminate your participation immediately if you breach these Terms or engage in conduct harmful to our brand.

  • Upon termination, you must remove all TJV ATV promotional materials and cease using your affiliate link.

8. Limitation of Liability

  • TJV ATV will not be liable for indirect, incidental, or consequential damages arising from participation in the Program.

  • TJV ATV’s total liability for any claim related to the Program will not exceed the total commissions paid to you in the previous 6 months.

9. Modification of Terms

  • TJV ATV reserves the right to update or modify these Terms at any time.

  • Continued participation in the Program after changes are posted constitutes your acceptance of the updated Terms.

10. Governing Law

  • These Terms are governed by the laws of Malaysia.

  • Any disputes will be subject to the exclusive jurisdiction of the courts in Kedah, Malaysia.

By joining the TJV ATV Affiliate Program, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
